Application to Vary a Premises Licence

An application had been made by The Barlow Institute, Bolton Road, Edgworth, Bolton, BL7 0AP to vary premises licence LP8490, in respect of the Barlow Institute, Bolton Road, Edgworth, Bolton, BL7 0AP.

 

The variation sought was or a change to the plan of the premises to include an extension to live music, recorded music, performances of plays and performances of dance (both indoors and outdoors), films and indoor sporting events (indoors only), from 9am to 11pm on Monday to Thursday and 9am to 1am on Friday to Sunday.

 

The application also included an extension to the supply of alcohol for consumption on and off the premises of alcohol until 1AM Friday to Sunday, and 11pm from Monday to Thursday

 

All the Responsible Authorities have been consulted and public notices had been displayed and published in accordance with the Licensing Act 2003 (Premises licences and club premises certificates) Regulations 2005.

 

Licensing Officers did receive a call from one of the objectors during the original consultation period, reporting that the blue notice at the premises was not being displayed correctly.

 

On visiting the premises the officer found the notice was displayed in a notice board, but that the date of the notice had been obscured by another document being displayed underneath it. This was brought to the applicant’s attention and they promptly uncovered the bottom of the notice and the consultation period was extended to the 21st June 2022.

 

There were two objections to this application submitted by local residents at the end of the consultation period.

 

The first representation was from Mr Geddes, who is concerned about traffic and parking issues, along with the potential for noise nuisance and disturbance from patrons leaving the venue late at night that extended hours would generate.

 

The second representation was from Mr and Mrs Bancroft, who were also concerned about traffic, parking, noise nuisance and general disturbance from patrons leaving the venue, if the application was approved.

 

Some additional conditions had been agreed with the Public Protection Service, during the consultation period in respect of Challenge 25 and staff training.

 

The Panel considered all the concerns including parking, noise, traffic and signage. They had also considered the additional conditions that had been tendered by the applicant to address those concerns.

 

The Committee were concerned about the complaints but were of the opinion on balance that the additional conditions put forward by the applicant would be appropriate to address these.

 

The Panel also reminded the applicant that the statutory bodies have a range of enforcement options at their disposal to address noise etc. These options could ultimately involve the magistrate’s court if the issues were allowed to continue.

 

RESOLVED –

 

It was the decision of the Sub-Committee to grant the variation of the premises licence with conditions as set out in Appendix 7 subject to the following amendments:

 

Removal of the extension of playing live music in the outside areas until 11pm – this to remain at the current 9pm deadline as per the existing licence.

 

Operating hours

Sunday 9am to 11pm – except when preceding a Bank Holiday Monday where an extension will be granted to 1am.

 

Monday to Thursday – 9am to 11pm
